Terms of Service for Silent Whisper

Please read these Terms of Service ("Terms") carefully before using the Silent Whisper application ("Service", "App"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using Silent Whisper, you confirm that you are at least 13 years old, that you have read and understood these Terms, and that you agree to comply with them. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

Silent Whisper is an anonymous, end-to-end encrypted messaging platform that allows registered users to receive anonymous messages from others via a unique sharing link. The Service includes:

Creating a personal sharing link that others can use to send you encrypted messages.
Receiving, reading, and managing encrypted messages in your inbox.
Optional Pro features (pinning, archiving, replies, export, voice messages, etc.) available via a paid Google Play subscription.

3. Accounts

3.1 Registration

You may register using an email address and password, or via Google Sign-In. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.2 Guest Accounts

A Guest Account can be created without registration. Guest accounts and all associated data are automatically and permanently deleted 7 days after creation. We recommend converting your Guest Account to a full account if you wish to keep your messages.

3.3 Account Security

You agree to notify us immediately at laxmi.solutions.2025@gmail.com if you become aware of any unauthorised use of your account. We are not liable for losses arising from unauthorised access caused by your failure to safeguard your credentials.

3.4 Accurate Information

You agree to provide accurate and current information when registering. Providing false, misleading, or impersonating information may result in immediate account termination.

4. User Conduct

You agree not to use Silent Whisper to:

Send, transmit, or store any content that is illegal, harassing, threatening, defamatory, obscene, or fraudulent.
Send AI-generated, bot-generated, bulk-automated, or spam messages.
Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
Send content that constitutes child sexual abuse material (CSAM) or that exploits minors in any way.
Promote, facilitate, or engage in any criminal or illegal activity.
Circumvent, reverse-engineer, or interfere with any security feature, rate limit, or access control of the Service.
Use automated scripts, crawlers, or bots to access or interact with the Service.
Use the Service in any manner that could damage, disable, overburden, or impair our servers or infrastructure.

Violation of these rules may result in immediate account suspension or permanent termination, and may be reported to relevant authorities.

5. Content and Encryption

5.1 Your Content

You own the content you send and receive through Silent Whisper. By using the Service, you grant us a limited, non-exclusive, worldwide licence to store and transmit your content solely as necessary to provide the Service.

5.2 End-to-End Encryption

All message content is encrypted on your device before transmission. We cannot read, access, or moderate the content of messages. You are solely responsible for the content you send.

5.3 Content Removal

Because messages are end-to-end encrypted, we cannot review message content. However, we can act on the metadata and reports we receive. We reserve the right to suspend accounts or sharing links found to be engaged in conduct that violates these Terms, even without accessing message content.

6. Reporting and Moderation

If you receive a message that you believe violates these Terms or applicable law, you may file a report via the in-app reporting feature. You may optionally provide a decrypted copy of the message content for review. Reports are reviewed by our team. We may take action including warning, account suspension, IP banning, or referral to law enforcement.

7. Pro Subscription and Payments

7.1 Pro Subscription

Pro features are unlocked via a recurring subscription purchased through Google Play. Subscription pricing is displayed in the Google Play Store at the time of purchase.

7.2 Billing and Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Google Play account settings.

7.3 Refunds

Refunds are governed by Google Play's refund policy. We do not process refunds directly. For refund requests, contact Google Play support.

7.4 Downgrades

If your subscription expires or is cancelled, your account will be downgraded to the free tier. Pro-tier messages and data that exceed free-tier limits will remain accessible but cannot be expanded further until Pro is renewed.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

9. Intellectual Property

All content in the Silent Whisper application — including but not limited to the name, logo, design, software, and copy — is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, error-free, or free of viruses.
Any defects in the Service will be corrected.
The Service will meet your requirements or expectations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SILENT WHISPER OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or ₹500 (five hundred Indian Rupees), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Silent Whisper and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you send through the Service.

13. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for:

Violation of these Terms.
Extended inactivity (accounts inactive for more than 12 consecutive months).
Fraudulent, abusive, or illegal activity.

Upon termination, your right to use the Service ceases immediately. We may delete your account and all associated data. Sections 5, 10, 11, 12, 13, and 14 survive termination.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

15. Changes to These Terms

We may update these Terms at any time. When we do:

The "Last updated" date at the top will change.
For material changes, we will notify you via in-app notification or email at least 14 days before the changes take effect.
Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

16. Miscellaneous

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Silent Whisper regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.
Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
