Terms of Service for Xylophone

Please read these Terms of Service ("Terms") carefully before using the Xylophone application ("Service", "App"). By installing or using the Service, you agree to be bound by these Terms. Because Xylophone is designed for young children, these Terms are directed to the parent or guardian who installs and supervises use of the App.

1. Acceptance of Terms

By downloading, installing, or using Xylophone, you confirm that:

You are the parent or guardian of the child using the App, or are otherwise an adult authorised to accept these Terms.
You have read and understood these Terms and agree to comply with them.
You will supervise your child's use of the App as appropriate.

2. Description of Service

Xylophone is a musical toy app that runs entirely on your device. It lets you:

Tap seven colourful keys to play real instrument notes.
Switch between three octaves (Low, Mid, High) and adjust the volume.
Record a short tune and play it back.

Xylophone has no accounts and stores tunes and settings only on your device.

3. No Accounts

Xylophone has no registration or login. Your tunes and settings live on your device. Uninstalling the app or clearing its storage permanently removes them.

4. Free Version, Ads, and Xylophone Pro

4.1 Free Version (Ad-Supported)

The free version of Xylophone is supported by advertisements served by Google AdMob. Because the App is directed to children, ads are configured to be child-directed and non-personalised and limited to a "G" (everyone) content rating, in line with Google Play's Families policy. By using the free version, you agree to the display of these ads. Details are in our Privacy Policy.

4.2 Xylophone Pro

Xylophone Pro is a one-time in-app purchase processed through Google Play Billing that removes all ads and unlocks saving your recorded tunes so they are kept between sessions. It is not a subscription. The price is shown in-app at the time of purchase. The Pro entitlement is tied to the Google account used to buy it and can be restored on your devices through Google Play.

Without Pro, you can still record and play back a tune during a session; saving it for next time is a Pro feature. All tunes are stored only on your device (see our Privacy Policy).

4.3 Refunds

Refunds are governed by Google Play's refund policy. We do not process payments or refunds directly.

5. Permissions

Xylophone requests only the permissions needed to operate: internet access (to load ads in the free version and to communicate with Google Play) and billing (to purchase Xylophone Pro). It does not request access to the microphone, camera, contacts, photos, or location. The "record" feature records only on-screen key taps, not sound.

6. Your Responsibilities

By using Xylophone, you agree that:

You will supervise children using the App, including any interaction with ads or purchase flows.
You will not reverse-engineer, decompile, or tamper with the App, or circumvent any payment, access-control, or security feature.
You will use the App in compliance with applicable law and the Google Play Terms of Service.

7. Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference. Xylophone processes everything on your device and does not collect personal data.

8. Intellectual Property

All content in the Xylophone application — including the name, logo, design, software, sounds, and copy — is owned by or licensed to us and protected by applicable intellectual property laws. You may not copy, modify, or distribute our intellectual property without written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or ₹500 (five hundred Indian Rupees), whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Xylophone and its operator from any claims, liabilities, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights or applicable law.

12. Termination

These Terms apply for as long as you use the Service. You may stop using Xylophone at any time by uninstalling it. We may discontinue the Service or release updates that change its features. Purchased entitlements are handled by Google Play.

13. Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in India. We encourage you to contact us before pursuing formal proceedings.

14. Changes to These Terms

We may update these Terms at any time. For material changes we will surface a notice in the app or update the "Last updated" date above. Continued use after the effective date constitutes acceptance.
