Terms of Service for ScribbleMate

Please read these Terms of Service ("Terms") carefully before using the ScribbleMate application ("Service", "App"). By installing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using ScribbleMate, you confirm that:

You are at least 13 years old.
You have read, understood, and agree to comply with these Terms.

If you do not agree, please do not use the Service.

2. Description of Service

ScribbleMate is a freemium, ad-supported mobile application for drawing over other apps. The Service lets you:

Draw, highlight, and annotate on a floating overlay on top of any app.
Save your annotations as boards and reopen them later.
Optionally capture a screenshot that combines your drawing with the screen behind it.
Unlock additional tools and unlimited boards by purchasing Pro (see Section 7).

All of your data is stored locally on your device. ScribbleMate has no account system and no cloud — your boards never leave your phone unless you choose to share them.

3. No Account Required

ScribbleMate does not require registration. You use the app without creating an account or providing personal information. Because there is no account, your data lives only on your device and is not recoverable by us if your device is lost, reset, or the app is uninstalled. We recommend using your device's own backup features if you wish to preserve your data.

4. The Overlay and Acceptable Use

ScribbleMate draws on top of other applications using Android's "Display over other apps" permission. The overlay only paints your drawings; it does not read or record the apps beneath it.

You are responsible for how and where you use the overlay. You agree not to use ScribbleMate to:

Obscure, imitate, or interfere with security prompts, system dialogs, or other apps in a deceptive or harmful way.
Annotate or capture content you do not have the right to view, copy, or share.
Violate the rights or privacy of any other person.

5. Your Content and Responsibilities

5.1 Your Boards

You own and are solely responsible for the drawings, boards, and captured images you create in ScribbleMate. We claim no rights over your content and have no access to it.

5.2 Backups

Because your content is stored only on your device, you are responsible for any backups. We are not liable for loss of data resulting from device failure, loss, reset, uninstalling the app, or clearing app storage.

5.3 Prohibited Uses

You agree not to:

Reverse-engineer, decompile, or tamper with the application, except where permitted by law.
Use the Service in a way that interferes with or disrupts the advertising networks it relies on.
Attempt to defraud the advertising system (for example, generating invalid ad clicks or impressions).
Attempt to circumvent, fake, or tamper with the Pro purchase or licensing checks.
Use the Service for any unlawful purpose.

6. Advertisements

For users who have not purchased Pro, ScribbleMate is supported by advertisements served through Google AdMob, including banner, interstitial, and app-open formats. No ads are shown over the drawing overlay. By using the free version of the Service, you agree to the display of these ads. Advertising data practices are described in our Privacy Policy.

7. Purchases and Pro

ScribbleMate offers a one-time in-app purchase that unlocks Pro, which removes ads and enables additional tools and unlimited boards.

Purchases are processed by Google Play Billing. We do not receive or store your payment details.
The Pro unlock is a one-time purchase, not a subscription. There are no recurring charges.
Pro is tied to your Google account and can be restored on supported devices using the "Restore purchase" option.
Refunds are handled in accordance with the Google Play refund policy and applicable law. We do not separately process payments and therefore cannot issue refunds outside of Google Play.
We may change the price or composition of Pro features for future purchases; changes will not retroactively revoke an unlock you have already paid for.

8. Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference. Your boards are stored entirely on your device and are never uploaded to our servers, and ScribbleMate cannot see the content of your screen beneath the overlay.

9. Intellectual Property

All content in the ScribbleMate application — including the name, logo, design, software, and copy — is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, modify, or distribute our intellectual property without written permission.

The content you create in the app remains your own property.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted or error-free, or that the overlay and capture features will behave identically across all devices and Android versions, as these depend on your device and operating system.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA OR CONTENT — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability for any claim shall not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) ₹500 (five hundred Indian Rupees).

12. Indemnification

You agree to indemnify and hold harmless ScribbleMate and its operator from any claims, liabilities, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.

13. Termination

These Terms apply for as long as you use the Service. You may stop using ScribbleMate at any time by uninstalling the app. We may discontinue the Service, or any feature of it, at any time. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

14. Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in India. We encourage you to contact us before pursuing formal proceedings.

15. Changes to These Terms

We may update these Terms at any time. We will reflect material changes by updating the "Last updated" date and, where appropriate, via an in-app notice. Continued use after the effective date constitutes acceptance.
